We have considerable knowledge and experience of dealing with the administration of estates and are well placed to advise and share with the executors or administrators (also known as ‘personal representatives’ or ‘PRs’) the burden of their legal responsibilities at a very difficult time.

What we do

We can assist the PRs in the discharge of their duties by securing the assets of the estate, obtaining the necessary valuations to complete any inheritance tax return required by HM Revenue & Customs (‘HMRC’), paying any tax which falls due, obtaining the appropriate Grant of Representation, gathering in or selling the assets, paying the debts and liabilities of the deceased and ensuring that beneficiaries receive their entitlement under the terms of any will or on intestacy.

At the conclusion of the administration process we will also provide detailed estate accounts together with income tax statements for the beneficiaries so that they can ensure they have accurately reported their share of any estate income to HMRC. We can also assist in completing the deceased’s income and capital gains tax affairs to the date of death and settling any liability directly with HMRC.

In addition, the firm owns and operates a corporate trustee, Cleaver Fulton Rankin Trustees Limited, which can be appointed by PRs to act on their behalf as an attorney for the purposes of administering an estate. This is particularly useful for those PRs who have insufficient time to devote to the process or who reside outside the jurisdiction. We are also willing and able to take on administration work from other law firms in cases where the PRs consider that insufficient progress is being made or where there are is a complex or unusual aspect to the estate.
