The team is led by Brendan Fox who was recently described in the Chambers Legal Directory as a “man of great energy” and “a formidable litigator”. He is assisted by the talented pair of Patrick Fleming and Jonathan Forrester. The team always goes beyond the call of duty for clients to provide commercial, practical advice designed to achieve the most cost efficient result.
The team handles multi-million pound disputes, mortgage repossession and forfeiture actions on behalf of local and national landlords and property developers. Having successfully concluded the multi-million pound class action on behalf of 66 residents of Rossorry Quay, Enniskillen in relation to the construction of 42 townhouses and apartments, the team has certainly shown its capacity to handle high profile, complex litigation.
Throughout the last year, they have defended and pursued the enforcement of Adjudicator’s Awards and has acted for employers, developers, specialist contractors, consultants and industry professionals in High Court disputes. This has resulted in real growth in demand for its advice on procurement disputes.
The team has enjoyed considerable experience of Alternative Dispute Resolution. In particular, they have been involved in adjudication, arbitration and mediation. Both Brendan and Jonathan have been involved in mediations concerning high value, multi-party construction disputes. Jonathan has also successfully completed the Alternative Dispute Resolution and Mediation training course provided by the Law Society of Northern Ireland.
The team also has an extensive and growing non-contentious construction practice and currently advises prominent developers, professionals and contractors on a number of ongoing projects. We currently advise on non contentious issues relating to the contractual documentation, appointments and collateral warranties for clients in both the public and private sector (link to PFI/PPP Projects).
