It is an unfortunate reality in todays current economic climate that mortgage repossession is something many businesses and individuals face. Whether you are a property developer, commercial property owner or someone with their own home, our team are here to advise you on how best to deal with your arrears and to prevent mortgage repossession.
Banking clients
Whilst we have experience in working with borrowers and tenants, the vast majority of the teams experience lies in advising international banking clients on the mortgage repossession process in Northern Ireland. Currently the team acts for db mortgages, Standard Life Bank Limited, HSBC plc, Scottish Widows plc, Future Mortgages and CitiFinancial
We have three solicitors from the Litigation Department within the mortgage repossession team. One solicitor is usually assigned to each new client. This allows clients to have one point of contact who is well versed in the bank’s policies, cases and of course the mortgage repossession process.
Once an order is obtained from court the file is then passed to Charles Stuart who is in our Debt Recovery Team. He progresses the enforcement of the order through the Enforcement of Judgements Office.
Once the property has been taken into the possession of the bank the file is passed to Bronagh Gunn or Janet Knox in the Property Department who deals with the onward conveyance of the property.
The team is also able to deal with more unusual scenarios including abandonment of property, partition applications, payment protection plans, voluntary surrender, serving proceedings abroad, advising when the borrower is deceased, applications for substituted service right through to more serious issues such as mortgage fraud, environmental issues on mortgaged premises and professional negligence.
