The Charities Act (Northern Ireland) 2008 – Provisions in OperationApril 6, 2009
The Department for Social Development has made the first Commencement Order under the Charities Act (Northern Ireland) 2008 so that with effect from 27 March 2009 certain provisions of the Act have been brought into operation.
This relates to the establishment of the Charity Commission for Northern Ireland and enables it to issue guidance on the Public Benefit Test which is one of the conditions an institution must be able to satisfy in order to be recognised as a charity. It also brings into effect provisions providing for the disclosure and exchange of information by the Commission, certain conditions for exercise of legislative making powers and enables the Department to amend the Act to reflect further changes in company law and other general powers.
